1. Acceptance of these Terms
PEGUIM TECNOLOGIA LTDA, a private legal entity registered under CNPJ/MF No. 54.316.599/0001-04, with registered address at Rua São Paulo, No. 193, Poloni, São Paulo, Brazil ("Company," "we," "us," or "our"), sets out these Terms of Use, which govern access to and use of the Seringueiro application, website, systems, features, and related platforms (together, the "Platform") by any individual or entity that registers with or uses the Platform (the "User," "you," or "your"). By accessing, installing, or using the Platform, you agree to be bound by these Terms.
2. Use of platform features
The Platform includes logistics, agricultural, networking, and content features. By using them, you agree to the following rules.
2.1. Trip tracking responsibilities
- Activation: You are responsible for starting tracking at the beginning of a tracked trip or activity and ending it when the trip or activity is completed.
- Integrity: You must not falsify, block, or alter GPS data, including through GPS spoofing or similar tools.
- Permissions: You must grant the location permissions required for background operation, including "Allow all the time" or equivalent settings where applicable.
- Battery and resources: Trip tracking makes intensive use of GPS, background services, and, on iOS, Live Activities, which may significantly increase battery usage. You are responsible for keeping your device sufficiently charged during operation.
- App data: Clearing app storage or uninstalling the app before pending data is synchronized may cause irreversible loss of the current trip or activity data.
2.2. Technical limitations
- GPS accuracy: Tracking depends on GPS signal availability and may be affected by weather, tunnels, buildings, vegetation cover, or other environmental conditions.
- Transmission failures: Data collected offline may be stored temporarily and sent when connectivity is restored, subject to device storage and system conditions.
2.3. Property registration and CAR
- Accuracy of information: When registering a property or providing a CAR (Cadastro Ambiental Rural) number, you represent that the information is accurate and that you are legally authorized to manage the relevant production unit.
- Lookup limitations: CAR-based autofill is an auxiliary feature based on public data sources. We do not guarantee continuous availability or absolute accuracy of those third-party or governmental data sources.
- Use of coordinates: The coordinates you provide may be used as a reference for climate and operational services. Forecast quality depends in part on the accuracy of the location you provide.
2.4. Production records (Harvest Collection)
- Accuracy: You represent that all production data entered, including quantity, type, and location, is accurate and reflects operational reality. False information may result in account restrictions.
- Photo content: Uploaded photos must relate to agricultural production, packaging, or collection sites. You must not upload unlawful, offensive, violent, or unauthorized third-party imagery.
- Publication license (Hub): If you choose the "Publish on Hub" feature, you grant the Company a non-exclusive, worldwide, royalty-free license to display, distribute, and promote the related collection data, including photos and descriptions, within the Platform.
- Offline mode: You acknowledge that offline data is stored locally and is subject to device integrity. We are not responsible for data lost before synchronization because of damage, formatting, theft, loss, or other device issues.
2.5. User-uploaded content
- Processing license: When you upload files, such as maps, documents, or photos, you grant us a non-exclusive license to process those files strictly for registration, validation, and related platform purposes.
- Prohibited content: You must not upload files containing malware, illegal material, or sensitive personal data of third parties without authorization. We may remove content that violates these rules.
2.6. Account and security
- Credentials: You are responsible for maintaining the confidentiality of your login credentials. Activities performed through your account are your responsibility to the extent permitted by law.
- Accuracy: You agree to provide truthful, accurate, current, and complete information during registration and to keep it updated.
- Personal use: Accounts are personal and non-transferable. Sharing credentials with third parties violates these Terms and may put account and data security at risk.
2.6.1. Account closure
- Request: You may request closure of your account at any time through the support or in-product channels that may be made available by the Platform.
- Irreversibility: Account deletion is permanent and may result in loss of access to associated data, history, and settings, subject to legal retention obligations.
- Social accounts: If your account was created through a third-party identity provider, deleting your account on the Platform does not automatically revoke the connection in the provider's own settings. You are responsible for revoking that access separately if desired.
2.7. Technical evaluations
- Technical accuracy: When carrying out technical evaluations, including scores and evidence, the responsible professional represents that the data entered accurately reflects field conditions and applicable technical protocols.
- Synchronization responsibility: Offline drafts are a temporary convenience. You are responsible for connecting to the internet periodically so evaluations can be synchronized and stored on the server.
- Risk of local-only data: Until synchronization is completed, those records remain only on the device. We are not responsible for loss of unsynchronized evaluations because of loss, theft, damage, or local data deletion.
2.8. Operational limits (slots)
Use of the Platform may be governed by operational limits based on the subscribed plan.
- Plan limits: Certain plans may allow only a limited number of active production modules, linked users, or other resources at one time.
- Exceeding limits: If a limit is exceeded, including after a plan change, you may need to deactivate excess items or upgrade your plan before full functionality is restored. We may block creation of new records or activation of additional modules until the account is regularized.
- Counting rules: Only items marked as active may count toward a limit, unless otherwise stated in the applicable plan terms.
2.9. Deliveries and commercialization
- Auxiliary tool: Financial calculations and allocation tools are operational aids. The Company does not provide accounting, tax, or legal advice through the Platform. Results depend on the data entered by the User and do not replace official records or fiscal documents.
- Tax responsibility: You are solely responsible for the accuracy of declared financial and tax information and for compliance with applicable fiscal obligations.
- Third-party data: When registering partners, co-producers, or other participants in a delivery, you represent that you have the authorization necessary to enter their data for that purpose.
- Immutability and chain of custody: Creating a delivery may lock linked production records and generate an audit snapshot intended to preserve operational integrity and prevent duplicate use of the same data in multiple transactions.
- Custody of exported documents: If you export and share delivery data, including PDFs, you are responsible for the custody, privacy, and security of the exported file outside the Platform.
2.10. Field tools
The Platform offers tools for monitoring and managing agronomic activities.
- Continuous tracking: When you start a field activity, you authorize the app to collect your location continuously, including in the background or while the screen is locked, for auditing, operational management, and productivity calculation.
- Device requirements: To support reliable tracking, you are responsible for enabling location services, granting the permissions requested by the app, and avoiding device settings that prematurely stop background execution where possible.
- Offline data: Activities performed without connectivity may be stored locally. You are responsible for reconnecting periodically to synchronize records and reduce the risk of data loss.
- Integrity: You must not manipulate or falsify field activity records, including through fake-GPS tools or similar mechanisms. Detection of those practices may result in suspension of access.
2.11. Professional network and public profile
- Responsible networking: Public-profile features are intended for professional networking and hiring in the agricultural sector.
- Prohibited conduct: You must not use other users' data for spam, harassment, unsolicited marketing, scraping, or similar abusive practices.
- Contact visibility: If you enable a public profile, you understand that your contact details, such as email and phone number, may become visible to other authenticated users of the Platform.
- Profile content: You represent that profile information, including profession, credentials, and experience, is accurate. Misuse of false professional credentials may result in suspension and, where appropriate, additional measures.
- Performance sharing: If you generate and share a performance image or card, you acknowledge that you are exporting Platform data and that the information reflects a snapshot at the time of generation.
2.12. Forum and user-generated content
- Responsibility for content: You are solely responsible for the texts, images, comments, and other content you publish in the Platform's forum or community areas. The Company does not endorse user opinions.
- Prohibited conduct: You must not publish content that is defamatory, offensive, obscene, hateful, violent, infringing, invasive of privacy, spammy, or otherwise unlawful.
- License of use: By publishing content in the forum, you grant the Company a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content within the Platform.
- Moderation: We may remove content that violates these Terms or is otherwise inappropriate under our reasonable moderation standards, and may suspend access by users who repeatedly or materially violate these rules.
2.13. Auxiliary tools and simulators
- Simulation nature: Calculators and simulators, such as the DRC Calculator, are estimation tools based on the data entered by the user.
- No guarantee: We do not guarantee that those calculations are accurate, current, or suitable for definitive commercial decisions.
- User responsibility: You are responsible for ensuring that the reference values and percentages entered into those tools are correct and up to date.
2.14. Climate tools and operational decisions
AgroClima and related climate features provide operational support based on weather forecasts.
- Predictive nature: Weather forecasts are probabilistic estimates, not guarantees. Local conditions may differ from what is displayed in the app.
- Decision responsibility: Labels, alerts, and recommendations shown by the app are decision-support tools only and do not replace local technical judgment.
- No liability for operational outcomes: To the maximum extent permitted by applicable law, the Company is not responsible for production losses, crop damage, or financial losses arising from decisions made based solely on the Platform's climate information.
- Third-party dependency: Accuracy and availability of weather-related data depend on external providers such as OpenWeatherMap.
2.15. Informational content and news
- Informational nature: News, technical articles, and market indicators displayed on the Platform are provided for informational and educational purposes only.
- No professional advice: Nothing on the Platform constitutes investment, legal, accounting, tax, or agronomic advice.
- Sources: Editorial content may be supplied by third-party partners, and market indicators may reflect historical averages or reference quotations that can be delayed or diverge from local spot markets.
3. Intellectual property
All software, design, content compilation, and source code relating to the Platform are owned by or licensed to the Company. Except as expressly permitted by applicable law, you may not copy, reverse engineer, decompile, or exploit the Platform or its components without authorization.
4. Changes to these Terms
We may change these Terms from time to time to reflect legal, regulatory, operational, or product changes. Continued use of the Platform after updated Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires a different form of notice or consent.

6. Disclaimers and limitation of warranties
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, the Company does not guarantee that the Platform will be uninterrupted, error-free, secure, or suitable for every purpose, or that content, reports, calculations, operational recommendations, or results will meet your expectations.
7. Limitation of liability
To the maximum extent permitted by applicable law, the Company is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of revenue, or loss of unsynchronized data arising out of or relating to use of, inability to use, or failure of the Platform.
Where liability cannot lawfully be excluded, the Company's liability will be limited to direct damages proven to have been caused by the Company, subject to any mandatory rights and remedies that cannot be waived under applicable law.
8. Suspension and termination
We may suspend or terminate access to the Platform, in whole or in part, if we reasonably determine that you violated these Terms, engaged in fraud or abusive use, attempted to compromise security, or where suspension or termination is required by law or regulatory order.
You may stop using the Platform at any time and request account closure through the available channels. Termination does not affect legal retention obligations or rights and obligations that accrued before termination.
9. Governing law and venue
These Terms are governed by the laws applicable to the contracting entity that provides the Platform to you, except to the extent mandatory law in your place of residence requires otherwise. Any dispute will be submitted to the courts with jurisdiction over that contracting entity, unless applicable law grants you a non-waivable right to bring claims elsewhere.
10. General provisions
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. Any failure to enforce a provision is not a waiver. These Terms constitute the entire agreement regarding use of the Platform, except for any specific supplemental agreements that may apply to particular services or plans.
